SCOPE
(1) These Terms and Conditions set forth the terms and conditions for the use of services and resources, made available via the Internet through the platform available at www.jim.org.
(2) Acceptance of these Regulations is a condition of use of the jim.org platform.
§2
DEFINITIONS
Whenever the following terms defined below appear in these Regulations, they shall be understood as follows:
a) Regulations - these Regulations;
b) Organizer - JiM Foundation with its registered office in Łódź, 105 Tatrzańska Street, 93-279 Łódź, Tax Identification Number (NIP) 7282455613, entered in the Register of Associations, Other Social and Professional Organizations, Foundations and Independent Public Health Care Centers kept by the District Court for Łódź Śródmieście in Łódź, XX Economic Division of the National Court Register, under KRS number: 0000127075.
c) Participant - a natural person participating in a training course on the basis of a sales agreement concluded with the Organizer.
d) Training - an online service of a training nature provided by the Organizer through the platform, including self-study, synchronous, asynchronous and blended training;
e) jim.org platform - the website, located at www.jim.org (including all sub-pages), enabling Participants to use the resources of the jim.org platform, in particular to browse resources, purchase and access purchased training courses,
f) Agreement - a sales agreement concluded by the Organizer with a Participant in accordance with the procedure specified in these Regulations;
g) Order - a declaration of intent made via the Order Form and aimed directly at concluding a Sales Agreement with the Organizer.
h) Data - data, including personal data of the Participant, provided by the Participant in the Order Form
i) Consumer - within the meaning of Article 221 of the Civil Code of April 23, 1964, Journal of Laws 2019.1145 i.e. - a consumer is a natural person making a legal transaction with an entrepreneur that is not directly related to his/her business or professional activity
j) Consumer Rights Act - the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014 item 827 as amended).
k) RODO - Regulation 2016/679 of the European Parliament and of the Council (eu) of April 27, 2016. On the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/we (General Data Protection Regulation) OJ.EU.L.2016.119.1
§ 3
TECHNICAL REQUIREMENTS
1) In order to use the resources of the jim.org platform, including participation in the training courses organized through it, it is necessary to have access to the Internet and a computer/tablet/mobile phone, allowing the proper display of the content of the jim.org platform.
The Organizer shall not be liable for the inability to use part or all of the resources of the jim.org platform if this inability is caused by technical deficiencies on the part of the Participant, in particular due to improper configuration of the Internet browser or insufficient performance of the equipment.
§ 4
ORDERS
1 The Participant may place orders 24 hours a day via the platform: https://jim.org/harmonogram-szkolen/.
(2) In order to conclude the Agreement with the Organizer, it is necessary for the Participant to fill in the order form located at https://jim.org/harmonogram-szkolen/ containing: the name and surname of the participant of the course, address, telephone number and email address to which the account on the jim.org platform will be assigned and to approve the order with the button "Place order and proceed to payment", and then to make payment for the training course through the selected form of payment.
(3) Payment for the training course can be made through one of the electronic payment systems accepted at the time by the Organizer;
4. the price listed next to each course is the price in effect at the time of ordering and is binding on the Participant and the Organizer. Failure to make payment within the time period the payment system operator expects to receive payment means cancellation of the purchase and cancellation of the order.
(5) The Participant may incur additional purchase costs resulting, for example, from bank commissions, fees to the Operators or other possible fees resulting from the payment method selected by the Participant.
6. at the Participant's request, the Organizer shall issue - based on the Participant's data provided in the registration process - bills and send them to the Participant in electronic form.
§ 5
ORDER EXECUTION
1) Access to training on the platform jim.org is launched after the payment is credited.
(2) The Participant shall receive a link to the training course at the e-mail address indicated in the form within 24 hours of receipt by the Organizer of confirmation of payment for the ordered training course.
(3) Access to the training is limited to one-time participation in the training or one-time reproduction of the training material.
§ 6
RIGHTS AND OBLIGATIONS OF THE PARTICIPANT
(1) Each Participant shall be obliged to use the jim.org platform in a manner consistent with the law and good morals, taking into account respect for personal property and intellectual property rights of third parties.
(2) The participant is obliged to enter data in accordance with the state of
factual and legal status
(3) The participant is obliged to familiarize himself with the content of these Regulations.
(4) The participant of the training undertakes not to disclose to third parties the materials constituting the content of the training, both in whole and in part, without the written consent of the Organizer.
(5) The participant of the training familiarizes himself with the training materials on his own.
(6) The participant is entitled to use the resources and services of the jim.org platform for his/her own use only All information and training materials posted on the jim.org platform are subject to legal protection
All information and training materials posted on the jim.org platform are subject to legal protection, and their use for commercial purposes is not allowed and will be treated as copyright infringement.
7 Upon completion of the training, the participant will receive a certificate confirming participation in the training, including the title of the training, number of training hours, data of the organizer and the participant.
§ 7
RIGHTS AND OBLIGATIONS OF THE ORGANIZER
(1) The service shall be performed with due diligence by the Organizer.
(2) The Organizer's liability is excluded if:
a/ The Participant acts unlawfully,
b/ the Participant has provided false data and information about himself/herself and information used to perform the Service.
(3) The Organizer has the right to deny access to the resources of the jim.org platform to a given Participant, either permanently or for a period of time specified by the Organizer, in case:
a/ providing incorrect or incomplete data and information,
b/ suspicion of unlawful use of the jim.org platform by the Participant or in a manner inconsistent with these Regulations,
c/ other significant reasons preventing the provision of Services by the Organizer, of which the Participant will be informed.
(4) In cases of denial of access to the resources of the jim.org platform for reasons attributable to the Participant, the Organizer shall not be obliged to refund the fee paid by the Participant.
(5) The Organizer reserves the right to choose and change the type, forms, time and manner of granting access to the jim.org platform, of which it will inform the Participants in a manner appropriate to the change of the Regulations.
(5) The Organizer shall not be responsible for interruptions and disruptions in the provision of electronic services and access to the jim.org platform if the reason is:
a/ modernization, modification, maintenance or expansion of the Organizer's ICT system or software;
b/ actions of third parties independent of the Organizer, including force majeure.
(6) The Organizer shall not be liable for the inability or impediment to use the jim.org platform due to reasons attributable to the Participant.
§ 8
OCHRONA DANYCH OSOBOWYCH
1. Uczestnik wyraża zgodę wobec Organizatora na przetwarzanie danych zamieszczonych formularzu zamówienia w celu zawarcia umowy sprzedaży – przed jej zawarciem (tj. na podstawie art. 6 ust. 1 lit. a RODO).
2. W przypadku zawarcia umowy sprzedaży, Organizator przetwarza dane osobowe Uczestnika umieszczone w formularzu zamówienia, a także informacje o logowaniu się do szkolenia i sposobie korzystania z niego (w tym w zakresie częstotliwości korzystania) w celu wykonania umowy sprzedaży (tj. na podstawie art. 6 ust. 1 lit. a RODO).
3. Poza przypadkami, o których mowa w ust. 1-2, Organizator przetwarza dane osobowe Uczestnika wyłącznie w zgodzie z prawem, w tym wyłącznie w przypadkach, gdy – i w takim zakresie, w jakim – spełniony jest co najmniej jeden z poniższych warunków:
a/ przetwarzanie jest niezbędne do wypełnienia obowiązku prawnego ciążącego na Organizatorze jako administratorze danych;
b/ osoba, której dane dotyczą wyraziła zgodę na przetwarzanie swoich danych osobowych w jednym lub większej liczbie określonych celów, przy czym przetwarzanie na tej podstawie odbywa się pod warunkiem uprzedniego uzyskania zgody od ww. osoby, zgodnie z obowiązującymi przepisami prawa, w tym w szczególności w celu e-mail marketingu (adres e-mail) lub telemarketingu (numer telefonu);
c/ przetwarzanie jest niezbędne do celów wynikających z prawnie uzasadnionych interesów realizowanych przez Organizatora jako administratora danych.
4. Administratorem danych osobowych Uczestnika jest Organizator.
5. Cele i czas przetwarzania: dane będziemy przetwarzać w celu:
a. W celu zawarcia i wykonania umowy na podstawie art. art. 6 ust. 1 lit. b RODO w stosunku do stron umowy, oraz art. 6 ust. 1 lit. f RODO w stosunku do osób dedykowanych do realizacji umowy, przez czas trwania umowy i do czasu upływu terminów do dochodzenia roszczeń;
b. W celu rozpatrywania skarg i reklamacji na podstawie art. 6 ust. 1 lit. c RODO przez 1 rok po terminie upływu rękojmi lub rozliczeniu reklamacji;
c. W celu dochodzenia roszczeń związanych z zawartą umową na podstawie art. 6 ust. 1 lit. f RODO, gdzie prawnie uzasadnionym celem jest dochodzenie roszczeń i obrona przed roszczeniami, do czasu prawomocnego zakończenia postępowań w tym postępowania egzekucyjnego;
d. W celu archiwizowania dokumentów w tym dokumentów rozliczeniowych na podstawie art. 6 ust. 1 lit. c RODO – w zakresie dokumentów, których okres przechowywania jest regulowany przepisami prawa; art. 6 ust. 1 lit f RODO
– w zakresie danych przechowywanych przez okresy niezbędne dla dochodzenia roszczeń oraz obrony przed roszczeniami, a w przypadku konieczności przechowywania dokumentów narzuconej przez przepisy prawa
– przez okresy wskazane przepisami prawa;
e. Jeżeli wyrażono zgodę, to także dla celów prowadzenia działań marketingowych własnych produktów i usług bez wykorzystania środków komunikacji elektronicznej na podstawie art. 6 ust. 1 lit. f RODO, gdzie prawnie uzasadnionym celem jest prowadzenie działań marketingowych promujących prowadzoną działalność, do czasu wniesienia sprzeciwu.
f. Jeżeli wyrażono zgodę, to także dla celów prowadzenia działań marketingowych własnych produktów i usług z wykorzystaniem środków komunikacji elektronicznej, na podstawie art. 6 ust. 1 lit. f RODO , gdzie prawnie uzasadnionym celem jest prowadzenie działań marketingowych promujących prowadzoną działalność. Dane będą przetwarzane do czasu wycofania zgody na takie działania lub wniesienia sprzeciwu w zależności które ze zdarzeń nastąpi jako pierwsze.
g. W celach statystycznych na podstawie art. 6 ust. 1 lit. f RODO, gdzie prawnie uzasadnionym celem jest posiadanie informacji o statystykach prowadzonych przez nas działań co pozwala nam na usprawnienie prowadzonej przez nas działalności, do czasu gdy posiadamy dodatkową inna podstawę prawną przetwarzania – w razie gdy podstawę utracimy dane ulegają anonimizacji.
6. Dane możemy przekazywać odbiorcom, tj.:
a. podmiotom prowadzącym działalność pocztową lub kurierską;
b. podmiotom umożliwiającym nam dokonywanie zdalnych operacji płatniczych;
c. bankom, w przypadku konieczności prowadzenia rozliczeń;
d. organom państwowym lub innym podmiotom uprawnionym na podstawie przepisów prawa;
e. podmiotom wspierającym nas w prowadzonej działalności na nasze zlecenie, w szczególności dostawcom zewnętrznych systemów wspierającym naszą działalność, w tym IT.
7. Każdej osobie której dane dotyczą przysługuje prawo dostępu do treści swoich danych oraz prawo ich sprostowania, usunięcia, ograniczenia przetwarzania, prawo do przenoszenia danych, prawo wniesienia sprzeciwu, prawo do cofnięcia zgody w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem (o ile dane przetwarzanie odbywa się na podstawie zgody),
wniesienia skargi do organu nadzorczego, tj. Prezesa Urzędu Ochrony Danych Osobowych.
8. Podanie danych jest niezbędne do zawarcia umów, rozliczenia prowadzonej działalności, udzielenia odpowiedzi na kierowane wnioski, rozpatrzenia skarg i reklamacji. W pozostałym zakresie podanie danych jest dobrowolne.
9. Dane osobowe nie będą przetwarzane w sposób zautomatyzowany (w tym w formie profilowania) w ten sposób, że w wyniku takiego zautomatyzowanego przetwarzania mogłyby zapadać jakiekolwiek decyzje, miałyby być powodowane inne skutki prawne lub w inny sposób miałoby to istotnie wpływać na naszych klientów. 10. W ramach wykonywanych czynności korzystamy z plików cookies w ten sposób, że obserwujemy i analizujemy ruch na naszych stronach jak również możemy podejmować działania marketingowe. 11.W przypadku danych osób dedykowanych do realizacji umowy administrator informuje, iż dane te pozyskał od strony z którą zawarł umowę, tj. od uczestnika. Dane te mogą obejmować: imię i nazwisko, numer telefonu,
adres email, adres.

§ 9
COMPLAINTS
1 In case of problems with access to the ordered and paid training, the Participant should immediately notify the Organizer by e-mail at szkolenia@jim.org.
2) Complaints about services provided by the Organizer will be considered within 14 days of receipt at szkolenia@jim.org.
(3) The response to the complaint shall be sent by the Organizer to the e-mail address provided by the Participant in the order form.
(4) In the description of the complaint, the Participant is obliged to provide as much information as possible and the circumstances of non-performance or improper performance of the Agreement by the Organizer, in particular: the Participant's data, including contact details and other data necessary to consider the complaint.
§ 10
COPYRIGHTS
(1) The Participant acknowledges that all materials made available to him/her as part of participation in the training on the jim.org platform are the exclusive intellectual property of the Organizer or other competent entities and are subject to legal protection under applicable laws (including the Act of 4 February 1994 on Copyright and Related Rights).
(2) The Participant undertakes to use the materials entrusted to him and the content contained therein (including, in particular, the training materials made available within the framework of jim. org) solely for the purpose of his own learning and not to make them available to third parties without the consent of the Organizer or the relevant copyright owner.
(3) A participant with a paid training course may only print, download and save additional training materials from the platform for personal use without the right to further distribute them.
(4) The participant is not entitled to download and save video lessons.
(5) If the participant wishes to use outside the platform the materials to which the Organizer owns copyrights, it is necessary to obtain written permission from the Organizer.
(6) The Organizer reserves the right to periodically update the content of the training courses offered as part of the continuous update service covered by the offer.
(7) In case of violation of the provisions of this section of the Terms and Conditions, the Organizer and the owners of copyrights may seek compensation from the Participant for any material and immaterial losses resulting from such violation.
§ 11
INFORMATION OBLIGATION/WITHDRAWAL FROM THE CONTRACT
(1) The Organizer shall inform the Participant who is a consumer that, in accordance with the provisions of the Act on Consumer Rights:
a/ a Participant who has concluded the Agreement remotely may withdraw from it without stating reasons by submitting an appropriate statement within 14 days from the date of conclusion of the Agreement, subject to paragraph 2.
b/ a specimen statement of the aforementioned withdrawal has been included in Appendix No. 1 to the Regulations; use of the specimen is not obligatory;
c/ pursuant to Article 28 of the Law on Consumer Rights, the 14-day period for withdrawal from the Agreement shall begin from the date of conclusion of the Agreement;
d/ in order for the Participant to meet the deadlines referred to above, it is sufficient to send a statement before their expiration to the email address szkolenia@jim.org.
(2) The Participant's right to withdraw from the Remote Agreement does not apply to the agreements referred to in Article 38 of the Consumer Rights Act, including in particular: a) an agreement for the provision of services, if the Organizer has performed the service in full with the express consent of the Participant, who was informed before the performance started, that after the performance by the Organizer he/she will lose the right to withdraw from the
Agreement; b) an agreement for the provision of digital content that is not recorded on a tangible medium, if the performance began with the express consent of the Participant before the expiration of the deadline for withdrawal from the
Agreement and after the Licensor has informed him of the loss of the right to withdraw from the Agreement.
(3) In the case of withdrawal from the Agreement by a Participant who is a consumer, the Organizer is obliged to immediately, no later than within 14 days from the date of receipt of the Participant's statement of withdrawal
from the Agreement, return to the Participant all payments made by him/her. The Organizer shall refund the payment using the same method of payment used by the Participant.
§ 12
FINAL PROVISIONS
(1) The Organizer shall make every effort to ensure the proper operation of the jim.org platform.
(2) The Organizer reserves the right to completely or partially disable the jim.org platform for an indefinite period of time in order to modernize or repair it.
(3) The organizer reserves the right to make changes to the regulations without giving any reason.
(4) The participant is obliged to familiarize himself with the changes in the regulations if he uses the jim.org platform in any way.
(5) In matters not covered by the Regulations, the provisions of Polish law shall apply, in particular the Act of April 23, 1964 Civil Code, the Act of May 30, 2014 on Consumer Rights, the Act of
February 4, 1994 on Copyright and Related Rights, as well as the provisions on personal data protection.
