Passed spec. Extension of the validity of rulings and additional care allowance

On Tuesday, the Lower House of Parliament approved the final content of the law, which is part of the so-called "anti-crisis shield" package.
The law was signed by the President and published in the Official Gazette on March 31, 2020.

Recall that the JiM Foundation requested, among other things, that the issuance of disability certificates be streamlined,
for extending their validity due to missed meetings of the Assessment Teams, and for additional care allowances for caregivers of children and adults with disabilities.

New circle of recipients of supplementary care allowance:

  • The benefit will be paid in the event of closure of a nursery, children's club, kindergarten, school or other similar facility, to an insured person who is released from work due to the need for personal care of the child:
    1. A child with a severe or moderate disability certificate until the age of 18 or
    2. A child with a disability certificate or
    3. a child with an evaluation on the need for special education
  • The allowance will also be available in the event of the closure of a school, revalidation center, support center, occupational therapy workshop or other day care facility of a similar nature due to coronavirus, which is attended by an adult with disabilities. Accordingly, benefits will be provided to caregivers of adults with disabilities who remain at home as a result of the closure of epidemic day care centers.

Validity of disability and degree of disability certificates:

Certificates of disability or degree of disability issued for a limited period, the validity of which:

  • Elapsed within 90 days before March 8, 2020. - that is, before the effective date of the Law on Special Arrangements for Preventing, Counteracting and Combating COVID-19, Other Communicable Diseases and Emergencies Caused by Them - provided that a subsequent application for a ruling is submitted within this period, remains valid until 60 days after the cancellation of the epidemic condition.

How to calculate whether a ruling remains valid? Check if it has expired between December 9, 2019 and March 8, 2020, and if another ruling has been applied for during this period.

  • Expires on March 8, 2020. - that is, the date of entry into force of the Law on Special Arrangements for Preventing, Countering and Combating COVID-19, Other Communicable Diseases and Emergencies Caused by Them - then remains valid until the expiration of 60 days after the cancellation of the epidemic state.

Validity is also preserved:

  • Parking Card - until the 60th day after the cancellation of the epidemic condition,
  • Social assistance benefit - the period indicated in the decision granting the benefit is extended for the period that the certificate of disability or degree of disability retains.

We would also like to inform you that pursuant to the Ordinance of the Minister of Family, Labor and Social Policy dated March 26, 2020, amending the Ordinance on Disability Assessment and Degree of Disability:

  • The doctor who is the chairman of the adjudication panel may assess the health of the applicant on the basis of medical records - if he considers them sufficient;
  • Persons with disabilities, already from the date of entry into force of the Law on Special Arrangements for Preventing, Counteracting and Combating COVID-19, Other Infectious Diseases and Emergencies Caused by Them - March 8, 2020. - will have the opportunity to obtain a certificate of disability or degree of disability, without having to appear in person at a meeting of the Disability Assessment Panel.
